Sony and Marvel DID have talks about including Spider-Man in upcoming Marvel films, however the talks fell through. Speculation is that they failed because Sony wanted creative control.
Read that again. Sony, who is failing at making good Spider-Man movies, wanted creative control over Marvel who just made Guardians of the Galaxy into a box office smash.
Why make a billion dollars with Marvel when you can lose money on an Aunt May movie?

My guess is that was posturing in order to get more money. In the end, only artists care if they have creative control as long as they make wheelbarrows full of money. I suspect the biggest reason Disney/Marvel wants to keep creative control is so they don't suck and prevent them from making wheelbarrows full of money.
Sony will lose some money on the next movie or two and then be willing to make a smaller wheelbarrow full of money in exchange for no stinking up the next movie.

There's one other group that can sometimes obsess about creative control, and was more likely in play here: marketing. They must make sure they don't dilute that oh-so-valuable Spiderman brand!

The leaked documents from the Sony hack show that internally they know they're fucking up with the Spider-Man license. Why wouldn't they do whatever they can to get some of that Marvel magic onto their brand? Eventually, people there are going to get pissed about all the money being wasted on mediocre Spider-Man properties and will sell the rights back to Marvel at a reduced rate.
Same thing with Fox and the Fantastic Four. Fox has already let Ghost Rider, Punisher, and Daredevil revert back to Marvel. They didn't even bother trying to sell them back. This is Fox's third try with FF, and you'd have to imagine that once this one fails, they'll let it go too. After all, they're at least not completely fucking up the X-Men.

I would argue that after X-men 3 and the Wolverine: Origins that the X-men movie franchise was gasping for air. Aaron Sorkin goes off of journalists who are "helping the hackers".
Look, the emails, documents, and videos are out there. Is the media supposed to ignore them? Wouldn't them ignoring these things be bad as well since they'd then be controlled by you?

The embarrassing emails I think are what's damaging Sony most. I think those are probably what Sony's most upset about because it can impact money makers for the next few years. And I think that's where they have the least moral high ground to be lecturing anyone about reporting on what's been leaked.
Who's getting paid what, I can kind of side with Sony. That's no one else's business. Trashing the talent working for you behind their backs? I'm afraid that's on them.

I get their argument. These were private emails, and they're wondering if the MSM is crossing a line and actually helping the crime by reporting what was in them.
However, the MSM is simply reporting what's out there, not things that are still private. Follow me?

But they are reporting on things that were only available because they illegally obtained. I didn't read the article above, but it seems to me that illegally obtained material should not be reported on, unless there are compelling public interests (ie. a crime being committed, etc). I see none here.

Fair enough, but isn't reporting the actual incident itself still helping the hackers? Maybe CNN didn't publish the Jennifer Lawrence nudes, but telling folks they were in existence allowed those folks to go looking for them.
