He was waiting for trial, not actually convicted.
Supreme Court precedent has established that the constitutional rights of pretrial detainees are distinct from those of convicted inmates, because criminal convictions can justify certain punishments, Parker argued.


In other news, it looks like Vermont is being a bitch specifically to this dude.
David McLean, an assistant attorney general for Vermont, said it has never been the policy of the state's Department of Corrections to compel pretrial detainees to perform manual labor, but he refused to comment on McGarry's case.


EDIT: And maybe Mr. McGarry is a douche who deserves all the punishment he gets, or maybe not. My opinion on all matters of law in this country is challenging the current status quo on everything at every opportunity. This wouldn't be necessary if the current criminal justice system wasn't more batshit insane than a cave full of guano, all the way from the feds down to the local level, and so unbelievably stubborn.
