In the meantime they can hold things up and violate people's rights. Even though they and everyone else knows they can't win.
This sort of thing is just going to keep happening until such time as there is an actual punishment put into place for any legislator, law enforcement officer, or judge that willfully enacts or enforces any law that violates the constitution. Because why not? Doesn't cost them nothing to pull this shit over and over.
