The FEDERAL government can't (or, at least, isn't supposed to. Dietary restrictions WILL be coming with Obamacare).
NY state constitution... I have no idea what it says about the matter.

Large-sized drinks sold at grocery and convenience stores -- including 7-11's infamous, 64-ounce Big Gulp -- were exempt from the ban, as were milk-based and alcoholic beverages.
Law's bullshit on this fact alone. Unless booze and lattes miraculously became calorie free.

American appetite for added sugar and soda has been steadily declining from the year 2000. The amount of calories in Americans’ diet from added sugar and soda plummeted 39 percent from the turn of the century, says the American Journal of Clinical Nutrition.

“Obesity continues to rise while at the same time soda consumption has decreased,” a representative for the American Beverage Association told the Daily Caller News Foundation. “Therefore, it defies logic to say that soft drinks are driving obesity in the United States.”
Granted, he's got every reason to lie but the data backs his lie.

That's not the same as saying it's contributing. Sugar still bad.
