I have no evidence, but my gut tells me Sony was pushing for this. Distracts from the emails and takes a few points out of their "incompetence" column and moves them to the "victim" column.

Let's think for a second what may happen. North Korea is already isolated, damn near bankrupt, and is nothing but the crazy insane asylum cousin we each have somewhere back in our family tree.
Sanction them? They'll buy their black market whatever from China or Russia.
Bomb them? There's the PR thing plus the fact that it may actually increase their GDP from the resultant scrap metal sales.
Shame/badmouth/shun them? That's been working well the past six plus decades.
Retaliate?
Addendum:
Hmm, what if someone says the hackers stole some mp3s? That always seems to get Sony riled up for a good witch hunt. Why can't I see the same level of enthusiasm here?

Obama's White House won't have the balls to do anything with the military.
It's starting to annoy me that more people aren't really pissed about what's going on. Two American companies have backed down to terrorist threats and the White House is silent.
The fucking extreme liberal Hollywood elite are calling these companies cowards, but mainstream America is eerily silent.

Hell, don't even leak it. Give the motherfucker to The Pirate Bay. Do it while the MSM photographs you holding up a middle finger to the hackers.
Release the statement:
"The North Korean hackers didn't want you to see this movie so they hacked our company. They released our employees' SS#s and health records. They released embarrassing internal emails. They stole 5 movies and posted them on pirate sites. They have seriously affected our profits on 6 films, have caused a PR nightmare several times over for us, and exposed us to class action lawsuits. Then they threatened all of you with violence if you tried to see our movie.
Again, all because they don't want you to see this film.
That's why we're releasing it for free to the entire world. We want everyone to see it. Tell your friends. DL it for them if they can't spread it to other sites. Burn it to DVDs and give them to everyone you know or even to strangers.
We hope they enjoy this little taste of their own medicine, and hope it shows anyone who tries to do this in the future that they might hurt us, but they will not dictate to us how to run our business."

The answers to all these questions is probably: contracts. They could probably be sued for loss of income if they intentionally give the film away by someone somewhere who gave them money and/or time. Seth and Franco can probably be sued if they make too much of a stink. If anyone involved did have some balls the lawyers would castrate them.
Either that or everything is going to plan and the film will be released a week late to many ticket sales.
