I hit level 21. Two more great pokemon ran away from me. We're leaving the city tomorrow, so leveling and easy pokestops end.

I think a clone would be super-hard, the success is due to the proprietary IP (Pokemon) more than anything.

The IP is a big part, but I think it was the sheer number of players that did it. It's running into other players that seems to make it most interesting for most users. If another game could get big enough to have that happening it could snowball bigger and compete. But that's a hard bar to hit without a strong well-loved IP.

Hit level 22 yesterday. Used a lucky egg and cashed in all my crappy pokemon to do it. Gonna be so slow for now on.

I'm about to hit level 16. I have accepted the fact that since I don't work or live on top of a pokestop or gym that I'm not going to be dominating at this game.

I think the gym fights are really stupid anyway. Plus, there's no overall scoreboard or tally to show who's winning...

Also caught Picachu today.

I hatched a Pikcahu. 2km egg. They are strangely rare (this is only the 2nd I've got so far) for something that's in a "common" egg.

Yeah, the only point of battling is to get a bit more magic dust and use up the items you otherwise wouldn't use for a small amt of XP. I can take down up to level 5/6 gyms with my 2 best Pokemon.

The college across the street from my office has three gyms and a bunch of Pokestops. All the gyms are yellow and lvl 6. They've always been yellow. I'm curious to see how that changes once the fall semester starts.

Michigan couple is suing.

This will be interesting to see how it plays out. The argument they're making isn't wrong.

You know there are other game developers out there making similar games right now. Should they be allowed to profit by sending their players to your property?

In related news, I had a long weekend and just realized I haven't fired the game up since lunch on Wednesday. I'm thinking of deleting it. Being truthful, aside from collecting, it really isn't fun.

As long as the digital elements are located in the park I don't think they have any legal case. Niantic can't be held responsible if the players can't figure out how to go to a park without tromping on private property. And they certainly can't make the case that public parks aren't meant for the public.

I think it would still be very legally iffy even if any of the pokestops or gyms the defendants were suing over were on private property. But if none of them are then I can't see how the case has a chance.

You've actually got to post "No Trespassing" signs if you don't want people trespassing on your private property. It's pretty dumb. I looked into it for when I put in beehives on the back lot hopefully in the spring.

That won't help with this lawsuit. Niantic is basically telling people: "You must go to these places physically to win."

In the case of a park, you're right. The problem for Niantic is that their game doesn't say "play only in the park". Plus, they're selling it in every town, even ones without parks.

Also, several pokestops and gyms are on private property, and the Pokemon themselves are found anywhere including restricted areas, private property, etc.

The vast majority of the game takes place off private property, but that's not where the debate lies.

Like I said, this will be interesting to watch.

Unfortunately for this case, that's where the debate is so far. The plaintiffs are asserting that Niantic should be held responsible for all the trespassing when in the specific case cited the pokestops and gyms are in the park. At least according to the article. They are claiming that Niantic should not have anything "on or near private property". They don't give a definition of near, however, nor a justification why public property "near" private property should not be treated as actual public property.

It's class action, so if they can actually get some folks with pokestops and gyms on their property to join in then maybe it will get more interesting. But so far it's either 1) people who live next to a park bitching about the wrong people using the park, or 2) a blatant cash grab.

I wonder if there's any previous case law around GPS mistakes. Like is there any case where a GPS showed the road going through someone's house and some drunk driver followed it into their living room so they sued the GPS maker. That sort of thing. That's fairly equivalent, I'd think.

That's what grabbed my attention. Many, many businesses, churches, the military, etc. aren't thrilled with gamers coming onto their property.

That's interesting, and I'd like to know as well. We've all hit GPS mistakes, but have they cost lives, jobs, etc?

Niantic does not have liability, people are responsible for their own actions, the end. They should post no trespassing signs, and call the police, and bring civil suits against the people.

I'll vote this. Otherwise you could sue any number of DIY TV shows, podcasts, websites, etc., into the ground.

Haven't played it in over a week, so I deleted it. Trying to clean my phone up. It's filled with apps I'm not using/playing.

I think the biggest disappointment for me was the actual battles. Really bad game play.
