Clearly it is a form of pie. Not because of crust and shape, but because of consistency. There is no way in which that is a cake.
Cake and pie are so completely different, I don't understand how there could be any confusion about this. Cake is composed of a large mass of baked starchy substance that forms a lattice of air pockets to support it's texture, on top of which is often added a very thin layer of sugary goodness. Pie is composed of a large mass of sweet or savory gelatin on top of a very thin crust of hard-packed starch. It's like the difference between a sack of fluffy wood shavings and a tub of wet concrete.
