The court case is actually rather interesting. It's freedom of speech vs. how the law says you must treat others professionally. (They really lose me with all the talk of dignity. I don't think the courts have any business getting down to that level of personal communication.)
I'm thinking the woman got railroaded because her messages were private and specifically state her personal beliefs. But maybe I read the details wrong?

I agreed with them based on the headline. I know "damn" is tame, but there's no need to use it in advertising.
However, once you see how and why it was used, I disagree with them. It wasn't part of the copy written by BK. It was a customer's reaction. Could they have bleeped it or not used him? Sure, but in the context I don't think it's horribly used. That word is so tame, he might as well be saying "golly".
Plus, what kids in 2020 are sitting around watching an ad that long? Their nose is buried in their phone watching online porn anyway.

An Indian comedian made a documentary saying negative things about the character. The Simpsons made a joke about political correctness aimed directly at Apu (read the article). Azaria, however, said he would stop doing the voice.
So we're clear, Apu is a caricature. Even though I've met Indians in real life that talk EXACTLY like him. He's also been shown to be far smarter than Homer, warm hearted, a good neighbor, and so on.
