While this isn't exemplary behaviour, let's keep in mind that people who've committed second degree murder have been known to get lighter sentences. I would say that it is way overboard, since a DUI is a crime not because someone did some harm, but that supposedly someone is more likely to cause harm. I have a problem with that kind of thing in general.
