It's not entirely without legal merit. Remarks maliciously made about various aspects of someone's life (sexuality falls in that category, particularly if it's an unmarried female) are, by law, given the label "defamatory per se" in all but a few states. Which is really just a nice way of saying, "The First Amendment will in no way, shape, or form being admitted as a legitimate defense for that remark."
